DMCA Policy
WGLG (“we,” “our,” or “the Website”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512, we have established the following policy to address claims of copyright infringement that may occur on or through our services.
This DMCA Policy describes the procedure for submitting infringement notices, how we respond to such notices, and the options available to users who believe their material has been removed or disabled in error.
1. Scope of Policy
This policy applies to all content hosted on our Website, including but not limited to:
- Articles, blog posts, and written analyses;
- Images, graphics, and infographics;
- Audio and video materials;
- User-submitted comments or contributions;
- Any downloadable or shareable digital content.
2. Submitting a DMCA Takedown Notice
If you believe that content available on this Website infringes your copyright, you or your authorized representative may send us a written notification that includes the following required information (as per 17 U.S.C. §512(c)(3)):
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the material that is claimed to be infringing, along with information reasonably sufficient to allow us to locate it (such as the specific URL).
- Your full legal name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information provided in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
Notices must be submitted to our Designated Copyright Agent:
Email: [email protected]
Mailing Address: 1091 Elm Drive, Garden City, New York, 11530, United States
Phone: +1-646-464-9633
3. Our Response to Valid Notices
Upon receiving a valid DMCA Notice, we will:
- Promptly remove or disable access to the allegedly infringing material;
- Notify the content provider, user, or member who uploaded the material;
- Provide information about how the user may submit a counter-notification if they believe the material was removed in error.
We may also take additional measures, including account suspension or termination, in cases of repeat infringement.
4. Submitting a Counter-Notification
If you believe your content was removed or disabled in error or as a result of misidentification, you may file a counter-notification with our Designated Agent. To be valid, a counter-notification must include:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled, along with the location where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for your judicial district (or, if outside the U.S., that you consent to jurisdiction of the courts where the Website is located) and that you will accept service of process from the complainant or their agent.
If a valid counter-notification is received, we may restore the removed material within 10–14 business days unless the copyright owner files a court action seeking to restrain the alleged infringement.
5. Repeat Infringers
We take violations of intellectual property seriously. It is our policy to terminate, in appropriate circumstances, the accounts of users who are found to be repeat infringers.
6. Limitations and Good Faith
We encourage copyright owners to consider whether fair use, license agreements, or other legal exceptions apply before filing a DMCA Notice. Filing false claims or misrepresentations in a DMCA Notice or counter-notification may result in liability for damages, including costs and attorneys’ fees.
7. Updates to This Policy
We may update this DMCA Policy from time to time to reflect changes in law, technology, or our business practices. Updates will be posted on this page with a revised “Effective Date.” Continued use of the Website constitutes acceptance of the updated terms.
